NYC Estate Attorney Ideas?

Hello:

We have had interesting times with three New York City estate attorneys. The first was fired by her giant famous law firm for malpractice ("moved on") and left us with the mess she made. That now needs to be redone properly so we are on the search.

So far we have met with an incredibly competent woman who who like but it is hard getting hold of here and everything goest through her receptionist, which is taking forever.

The other we met with is a nice person (great bedside manner, easy to reach) but does not really seem to know how stuff.

Time is running out and we really need someone who is the full package--reachable, responsive, communicative, talented, creative, experienced, etc..

Any happy experiences you have had please share their names. Thanks!

I would recommend looking through the ACTEC website for ACTEC Fellows, as those are generally the most reputable and experienced attorneys in the field.

[NY] Respondant retained attorney for child support, am I entiteled to court appointed counsel?

I tried asking the court themselves but i think the clerk did not understand what i was asking. Am i entitled to an attorney in NY if the opposing party retains or is assigned one? obviously i cannot adequately defend myself against an attorney.

Top Comment: I’m not your lawyer. I am a lawyer in NY in family law. A respondent to a willful violation petition is entitled to an appointed attorney if they financially qualify, because there is the possibility of a jail term. Other than that, in support matters, no you are not entitled to a free attorney. The other party hiring an attorney is not a factor, you are welcome to hire an attorney or represent yourself

Need a genuine good attorney in NYC

Hello bs! I just got married last month and currently have been in the US on a visa . My husband would like to help me apply for a green card. I am really busy with school and he is super busy with work so we really need an attorney who can file everything for us correctly, give us all the correct information, etc. I keep hearing New York immigration lawyers are predatory so could use a good recommendation. Thanks.

Top Comment: You want an attorney but you really don’t need one. Go to the USCIS subreddit the number of people with delayed cases because of barely competent attorneys trying to make the most out of a simple case. If you have a straightforward AOS case, file yourself, take a couple of weekends To gather your documents and 1 weekend to fill out the forms. I did mine by myself, and it was all wrapped up in 6 months (NJ). There are applications review services online too if you’d prefer that. Definitely browse through the USCIS subreddit for tips

Nyc wage theft lawyers?

I’m now 99% sure my employer is taking if not half, majority of my tips. A lot of lawyers pop up when I Google but I’ve never consulted a lawyer abt anything so just wanted to ask if anyone in nyc has good personal experience with a wage theft lawyer out here, thanks!

Note that it's legal to redistribute tips from servers to other non-management employees, but they can't keep them for the restaurant, or give servers' tips to owners/managers.

The US Department of Labor and the NYS Department of Labor both handle wage theft complaints. If they confirm a violation, they'll seek to recover your wages, either through a settlement, or through a lawsuit. They don't charge a fee; they're supported by taxpayers. Personally I'd opt for the US DOL; either could handle it, but tip allocation is regulated by federal law, and they have a lot of experience with these sorts of cases.

A private labor attorney is an also an option, but would cost some money, either up front, or as a contingency fee (percentage of your winnings). They'd might take the case for a contingency fee if you're owed a couple thousand dollars or more, but the amount depends on the attorney. They typically take 33% of a settlement reached before a trial starts, or 40% of a settlement or court award after a trial starts.

Please ignore everyone telling you to get barred in New Jersey - that requires getting a JD from an American law schools. New York only requires an LLM which is a lot less time and effort

NYC attorney for uncontested divorce (no kids)

My wife and I are separated and want to formally divorce. Our divorce is as amicable as one could ask for: we are both ready and willing to file, we have no kids, and we've already split our investment accounts/assets.

I gather that I can do the paperwork myself. However, I'd feel more comfortable with an attorney preparing the documents, and I'm happy to pay. Does anyone recommend a firm to use?

I reached out two and have been ghosted by both, despite both saying this will be a very straightforward process. One quoted me $2k (including court fees) and I had to hound the partner to give me the wire transfer instructions... no response.

Please let me know if you've used a firm in NYC and recommend them!

DIY POA in New York

Has anyone done a POA in NYS without a lawyer? I came across this form on the state senate website. Is all I need just to copy and paste it into a Word document and print it out and notarize, or is there more to it and it is somehow a bad idea?

Also, the form says that this is a statutory POA, but I saw elsewhere that all POAs in NY are durable by default unless you state otherwise in the POA document. Can someone confirm that this form would make a durable POA?
